₿itPoker — Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using any part of the ₿itPoker platform ("Platform"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not create an account or use the Platform.
These Terms constitute a binding legal agreement between you ("User," "you," or "your") and ₿itPoker ("we," "us," or "our"). We reserve the right to update or modify these Terms at any time. Continued use of the Platform following any such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
2. Eligibility
2.1 Age Requirement
You must be at least 18 years of age to create an account or use the Platform. By registering, you represent and warrant that you are at least 18 years old.
2.2 Jurisdictional Compliance
You are solely responsible for ensuring that your participation in poker and use of Bitcoin-denominated transactions is lawful in your jurisdiction. The minimum legal age for gambling may be higher than 18 in your location. It is your responsibility to know and comply with the laws of your jurisdiction. We do not represent that the Platform is available or appropriate for use in all locations.
By using the Platform, you represent that: (a) you meet the minimum age requirement in your jurisdiction; (b) your use of the Platform does not violate any applicable law or regulation; and (c) you are not located in a jurisdiction where such use is prohibited.
2.3 One Account Per Person
Each individual may maintain only one account on the Platform. Creating multiple accounts is strictly prohibited and will result in immediate suspension of all associated accounts and forfeiture of any balances or benefits.
3. Membership
3.1 Membership Tiers
₿itPoker offers the following membership tiers, each with distinct benefits, pricing, and terms:
• High Card — Free entry-level membership. No membership hours included. Seat fee applies at $15/hr (paid in sats, USD shown for reference only). All stakes are open to every member; tiers grant waitlist priority, not access. Standard waitlist position. Seat reservations up to 14 days in advance; a seat deposit is required, per Section 6.1. An unclaimed seat is held for 15 minutes after the scheduled start.
• Pocket Pair — Monthly or annual paid membership. Includes 2 membership hours per month. Additional hours at $13.00/hr. Unused hours roll over up to a 2-hour cap per period while the membership remains active and in good standing. All stakes open; Priority waitlist position. Seat reservations up to 30 days in advance; a seat deposit is required, per Section 6.1. An unclaimed seat is held for 20 minutes after the scheduled start.
• Top Set — Monthly or annual paid membership. Includes 6 membership hours per month. Additional hours at $12.00/hr. Unused hours roll over up to a 6-hour cap per period while the membership remains active and in good standing. All stakes open; Preferred waitlist position and access to tier-gated special events. Seat reservations up to 45 days in advance; a seat deposit is required, per Section 6.1. An unclaimed seat is held for 30 minutes after the scheduled start.
• Full House — Monthly or annual paid membership. Includes 12 membership hours per month. Additional hours at $11.00/hr. Unused hours roll over up to a 12-hour cap per period while the membership remains active and in good standing. All stakes open; Premier waitlist position, reserved-seat rights at marquee games, and tier-gated special events. Seat reservations up to 60 days in advance; a seat deposit is required, per Section 6.1. An unclaimed seat is held for 45 minutes after the scheduled start.
• Royal Flush — Lifetime one-time membership at 0.21 BTC, non-refundable. Includes the holder’s first 2,100,000 sats of event buy-ins. Unlimited membership hours with no seat fees ever. All stakes open; highest waitlist priority everywhere plus Royal-only games. Unrestricted seat reservations with early access before public announcements. An unclaimed seat is held for 60 minutes after the scheduled start. Because membership hours are unlimited, no seat deposit is forfeitable on this tier; the standing provisions of Section 6.2 otherwise apply. Direct line of communication with the founders. Guaranteed seat at the inaugural game and launch party. Exclusive Royal Society sat-denominated poker chip set. Early access to all future ₿itPoker offerings. Limited to 21 members worldwide; holders are collectively referred to as The Royal Society.
Tier details, pricing, and entitlements are subject to change. The most current tier information is available on the membership page of the Platform.
3.2 Membership Hour Rollover
Rollover of unused membership hours is available on all paid tiers, subject to the cap defined for each tier. The cap limits how many unused hours carry into a single new period, not the total balance; a member's standing balance may therefore reach the cap plus that period's grant. Rollover hours are forfeited immediately upon downgrade to a lower tier, cancellation of the membership, or lapsed payment. Membership hours hold no monetary value and cannot be transferred, sold, or exchanged.
3.3 No Refunds
We do not offer refunds for any service, membership, or product purchased on the Platform. All purchases are final. This applies without exception to monthly subscriptions, annual subscriptions, one-time lifetime memberships (including Royal Flush), timebank hour purchases, event buyins, and any other products or services offered through the Platform.
In the rare event that ₿itPoker, at its sole and absolute discretion, elects to issue a courtesy refund, such refund will be denominated exclusively in satoshis (sats) at the Bitcoin price at the time the refund is issued. No consideration will be given to the USD equivalent at the time of original purchase, and any difference in USD value between purchase and refund is not the responsibility of ₿itPoker.
3.4 Price Changes
We reserve the right to change membership pricing at any time and without prior notice. Any price changes will take effect at the next billing cycle for existing subscribers. Continued use of your membership following a price change constitutes acceptance of the new pricing.
3.5 No Mid-Term Changes
Membership tier changes — whether upgrades or downgrades — cannot be applied during an active membership term. Any requested changes will be queued and will take effect at the start of the next membership period. We do not offer pro-rated adjustments for mid-term changes.
3.6 Membership Suspension or Cancellation
We reserve the right to suspend or cancel any membership at any time, with or without prior notice, for any of the following reasons, including but not limited to:
• Violation of any provision of these Terms
• Cheating or suspected cheating during gameplay (see Section 4)
• Conduct harmful to other players, staff, or the Platform, whether physical or digital
• Fraudulent activity, misrepresentation, or abuse of the Platform
• Any action we reasonably determine to be detrimental to ₿itPoker's reputation, operations, business interests, or physical premises
• Harassment, threats, or abusive behavior directed at any person associated with the Platform
In the event of suspension or cancellation for any of the above reasons, no refund of any kind will be issued, regardless of remaining membership time, unused membership hours, unused timebank balance, or any other remaining value.
4. Cheating and Game Integrity
4.1 Zero Tolerance Policy
₿itPoker maintains a strict zero tolerance policy toward cheating in any form. Any player found to be cheating — or reasonably suspected of cheating based on available evidence — will be subject to one or more of the following: immediate removal from the active game, suspension or permanent termination of their account, and forfeiture of all associated funds including but not limited to buy-in, winnings, timebank balance, and any remaining membership value. No refund will be issued.
4.2 Prohibited Conduct During Gameplay
The following actions are strictly prohibited and constitute cheating under these Terms:
• Use of any electronic or mechanical cheating device during gameplay, including but not limited to devices capable of reading marked cards, transmitting hole card information, or assisting in real-time odds calculation
• Marking, bending, daubing, crimping, or otherwise altering playing cards in any way
• Introducing counterfeit chips or any chips not issued by ₿itPoker into the game
• Collusion with other players in any form, including but not limited to sharing hole card information, signaling hand strength, coordinating betting actions, or engaging in soft play intended to benefit a confederate at the expense of other players
• Chip dumping — deliberately losing chips to another player through intentional suboptimal or cooperative play
• Any other act of deception, manipulation, or exploitation of a Platform vulnerability intended to gain an unfair advantage in the game
4.3 Determination of Cheating
The determination of cheating or suspected cheating is at the sole discretion of ₿itPoker management and floor staff. Their decisions are final. We reserve the right to review available evidence including but not limited to footage, chip counts, and hand histories in making this determination. Where we have reasonable grounds to suspect cheating, we reserve the right to act accordingly including temporary suspension pending investigation. False accusations made in bad faith may themselves be grounds for disciplinary action.
4.4 Reporting
Players who witness or suspect cheating are encouraged to report it immediately and discreetly to a floor staff member.
5. Bitcoin Transactions and Payments
5.1 Bitcoin Denomination
All financial transactions on the Platform — including membership purchases, event buyins, and cashouts — are denominated and processed in Bitcoin (BTC) or satoshis (sats). USD figures displayed anywhere on the Platform are for reference purposes only and do not constitute a price in fiat currency. By using the Platform, you accept the inherent volatility of Bitcoin and agree that ₿itPoker is not responsible for any gains or losses arising from fluctuations in Bitcoin's value.
5.2 Transaction Finality
All Bitcoin transactions are final and irreversible once confirmed on the network. We are not responsible for transactions sent to incorrect addresses or for losses resulting from user error.
5.3 Lightning Network
The Platform utilizes the Bitcoin Lightning Network for payments. You acknowledge that Lightning Network payments are experimental in nature and that you use them at your own risk.
5.4 No Fiat Currency
₿itPoker does not hold, process, or transact in fiat currencies. All balances, transactions, and payouts are conducted exclusively in Bitcoin.
6. Event Participation and The Cage
6.1 Seat Reservations
Seat reservations for events require a timebank deposit at the time of reservation. The standard deposit is 2 hours; an individual event may set a different figure, and the amount shown at the time of booking is the amount that governs. A deposit is held, not spent: it does not reduce your balance until and unless it is forfeited under Section 6.2, and it is released in full when you attend, when we cancel the event, or when you cancel outside the window below.
6.2 Cancellations and No-Shows
The terms in force when you make a reservation are the terms that govern it. A later change to this section applies only to reservations made after that change.
A seat request that has not yet been approved may be withdrawn at any time at no cost. The provisions below apply to approved reservations, and are measured against the event’s scheduled start time.
• More than 72 hours before start — the deposit is released in full.
• Within 72 hours of start — 50% of the deposit is forfeited (1 hour of a standard 2-hour deposit).
• After the scheduled start, or a no-show — the full deposit is forfeited.
These amounts are the same on every tier. A tier changes how long your seat is held, not what a missed booking costs.
Arriving late is not a no-show. A no-show is a reservation that was neither cancelled nor claimed. Your seat is held past the scheduled start for the period stated for your tier in Section 3.1, and a seat that has not been released to another player when you arrive remains yours.
Your first missed booking in any 12-month period is waived automatically. It is recorded on your account and shown to you, and no hours are deducted.
Forfeited hours are deducted from your timebank balance and appear as an itemised entry in your transaction history. A forfeiture may be reversed at our discretion, and a reversal is posted as a credit rather than by removing the original entry.
Repeated missed bookings. Three or more forfeitable events within a 12-month period may result in advance seat reservations being suspended for 60 days. Seats remain available to suspended members on a walk-in basis for the duration.
Because Royal Flush carries unlimited membership hours, no deposit is forfeitable on that tier. The remaining provisions of this section, including the suspension provision above, apply to every tier.
6.3 Event Modifications
We reserve the right to cancel, reschedule, or modify any event at any time. In the event of a cancellation by ₿itPoker, any held deposits will be returned to the player's timebank balance.
6.4 Cashier (The Cage)
In-person transactions are processed through our cashier facility ("The Cage"). All cashier transactions are subject to these Terms and are final once settled on the Bitcoin network.
7. Responsible Gaming
₿itPoker is committed to promoting responsible gaming. We encourage all users to play within their means and to treat poker as entertainment.
If you believe you or someone you know may have a gambling problem, we encourage you to seek help. Resources are available through organizations such as the National Problem Gambling Helpline (1-800-522-4700) and Gamblers Anonymous (www.gamblersanonymous.org).
We reserve the right to implement account restrictions, cooling-off periods, or self-exclusion at the request of a user or at our discretion. Users who wish to self-exclude or set limits on their activity may contact us directly.
By using the Platform you acknowledge that: (a) gambling involves risk of financial loss; (b) you are participating voluntarily and with funds you can afford to lose; and (c) past results do not guarantee future outcomes.
8. Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to comply with this obligation.
You may not share, sell, transfer, or otherwise provide access to your account to any third party.
9. Prohibited Conduct
In addition to the conduct prohibited under Section 4, you agree not to:
• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
• Create more than one account
• Provide false, misleading, or fraudulent information during registration or at any time
• Use any automated system, bot, script, or other non-human means to interact with the Platform
• Attempt to gain unauthorized access to any part of the Platform or its infrastructure
• Harass, threaten, intimidate, or abuse other users, floor staff, or any person associated with the Platform
• Engage in any conduct — physical or digital — that we reasonably determine to be harmful to ₿itPoker, its staff, its members, or its business interests
• Use the Platform in any manner that could disrupt, damage, or impair its operation
Violations of this section may result in immediate account suspension or termination without refund and potential legal action.
10. Privacy
Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.
11. Intellectual Property
All content, trademarks, logos, and materials on the Platform are the property of ₿itPoker or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without our express written consent.
12. Disclaimers and Limitation of Liability
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by applicable law, ₿itPoker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of Bitcoin, or loss of data, arising out of or related to your use of the Platform.
Our total liability to you for any claim arising out of or related to these Terms or the Platform shall not exceed the amount you paid to us in the 30 days preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless ₿itPoker and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any applicable law.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of El Salvador, without regard to its conflict of law provisions.
Any dispute arising out of or related to these Terms or the Platform shall first be attempted to be resolved through good faith negotiation. If resolution cannot be reached informally, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ₿itPoker with respect to your use of the Platform and supersede all prior agreements and understandings.
